대한민국 정부와 포르투갈 공화국 정부 간의 취업관광프로그램에 관한 양해각서

2014년 4월 10일 서울에서 윤병세 대한민국 외교부 장관과 루이 마셰뜨(Rui Machete) 포르투갈 공화국 외교부 장관 간에 서명되어, 2014년 4월 10일에 발효될 예정인 ‘대한민국 정부와 포르투갈 공화국 정부 간의 취업관광프로그램에 관한 양해각서’를 고시합니다. 　　　2014년 4월 15일 　　　　　　　　　외교부장관 　 ⊙외교부 고시 제2014-1호 대한민국 정부와 포르투갈 공화국 정부 간의 취업관광프로그램에 관한 양해각서 　 대한민국 정부와 포르투갈공화국 정부(이하에서 "서명국"이라 한다)는, 양국 간의 더욱 긴밀한 협력 관계를 증진하기 위하여, 양국 간 상호이해를 제고하기 위하여 대한민국과 포르투갈공화국의 청년이 취업의 경험을 하는 동안 포르투갈공화국과 대한민국 각각의 문화와 생활양식에 대한 식견을 얻기 쉽게 하기를 희망하며, 대한민국과 포르투갈공화국 청년이 각각 포르투갈공화국 또는 대한민국에서 장기간 여행을 할 수 있도록, 그리고 포르투갈공화국 또는 대한민국에서 여행 경비를 보충하거나 또는 취업과 관련된 추가적인 연수 목적으로 그들 여행의 부수적인 활동으로서의 취업을 할 수 있도록 조치를 취하고자하는 의향으로, 이러한 청년 교류 활성화의 가치를 확신하며, 다음과 같이 양해에 이르렀다. 　 제1항 목적 이 양해각서는 (이하에서 "양해각서"라 한다) 취업관광 프로그램에 관한 서명국간 상호협력의 틀을 확립한다. 　 제2항 요건 각 서명국은 다음의 각 요건을 충족하는 상대 서명국의 청년에게 일 년간 유효한 취업관광 복수사증을 발급한다. (가) 대사관 혹은 영사관에 신청서가 접수되는 날에 18세 이상 30세 이하인 자 (나) 여권의 잔여 유효 기간이 12개월 이상 되는 유효한 대한민국 여권을 소지한 대한민국 국민 또는 여권의 잔여 유효 기간이 12개월 이상 되는 유효한 포르투갈공화국 여권을 소지한 포르투갈공화국 국민인 자 (다) 귀국항공권 또는 그 항공권을 구입하기에 충분한 경비를 소지하고, 초기 체류기간 동안 생계유지에 필요한 경비를 소지한 자 (라) 신청 혹은 참여 수수료, 그리고 관련된 그 밖의 수수료를 지불한 자 (마) 주재국 영역에 입국하기 전에, 입원치료와 후송비용을 보장하고 승인된 체류기간 동안 유효한 의료보험에 가입하기로 동의한 자 (바) 부양가족을 동반하지 아니한 자 (사) 이전에 취업관광사증으로 각각 대한민국 또는 포르투갈공화국에 입국한 사실이 없는 자 (아) 주재국 영역에 있는 기간 동안 그리고 필요한 경우에, 추가적인 직업특정보험에 가입한 자 (자) 주재국에서 여행을 하고 그 경비를 보충하기 위한 직업 활동을 한다는 의사를 확인한 자 (차) 범죄기록이 없는 자, 그리고 (카) 신체적 그리고 정신적으로 건강한 자 　 제3항 입국과 체류 1. 각 서명국은 상대 서명국의 취업관광 프로그램 참가자가 자국 영역에 입국하고 체류하는 절차를 용이하게 한다. 2. 포르투갈공화국 정부는 자격을 갖춘 대한민국 청년에게 입국일로부터 초기 4개월 동안 임시체류가 가능하며 12개월까지 연장 가능한 복수입국사증을 발급한다. 3. 대한민국 정부는 자격을 갖춘 포르투갈공화국 청년에게 입국일로부터 초기 3개월 동안 임시체류가 가능하며 12개월까지 연장 가능한 복수입국사증을 발급한다. 4. 이 사증은 해당 청년이 최대 일 년까지 주재국 영역에 입국하고 체류할 수 있는 기간을 표시하며, 체류의 사유를 명시한다. 5. 서명국은 상대 서명국의 영역에 위치한 대사관이나 영사관을 통해 제2호, 제3호 및 제4호에서 명시된 사증을 자격을 갖춘 청년에게 발급한다. 　 제4항 노동 허가 이 양해각서의 제3항에 규정된 임시체류 목적의 복수입국사증은 취업관광 프로그램 참가자가 주재국 영역에서 그들 여행의 부수적 활동으로서 취업을 할 수 있도록 한다. 　 제5항 일반 규정 1. 이 양해각서에 따라 다른 쪽 서명국에 체류하는 한쪽 서명국의 청년은 주재국에서 적용되는 국내법에 따른다. 2. 이 양해각서는 법적으로 구속력 있는 어떠한 의무도 창설하지 아니한다. 　 제6항 지원 단체 서명국은 그들 각국에 있는 관계 단체가 이 양해각서의 적용을 지원하도록, 특히, 상대 서명국의 청년이 정보를 얻고 직업 연수나 일자리를 찾을 수 있도록 조언을 제공하도록 장려한다. 　 제7항 참가자수와 적용 1. 각 서명국은 매년 최대 200개의 취업관광사증을 발급할 수 있다. 2. 서명국은 상호 서면합의를 통해 매년 발급되는 사증의 수를 변경할 수 있다. 3. 서명국은 제2항(다)호에서 요구하는 최소 자금액을 외교경로를 통한 상호 서면합의로 결정한다. 4. 각 서명국은 이 양해각서에 따른 취업관광 프로그램에 참여하게 되는 상대국 청년의 수를 추적하고, 매년 상대국에 그 수를 통보한다. 5. 제4호에 언급된 추적은 이 양해각서의 발효일에 시작하여 당해 발효년도 말까지 계속되고, 이후에는 매년 1월 1일부터 12월 31일까지 실행된다. 6. 서명국은 상호 서면합의에 의해 수반되는 행정조치에 대해 결정한다. 　 제8항 발효, 일시정지 및 정지 1. 이 양해각서는 서명일에 발효된다. 2. 이 양해각서는 어느 한쪽 서명국이 다른 쪽 서명국에게 이 양해각서를 정지할 의사를 나타내는 서면 통보를 한 날부터 6개월 후에 정지된다. 3. 어느 한쪽 서명국은 공공질서, 공중보건, 또는 국가안보를 이유로 언제든지 이 양해각서의 전부 혹은 일부의 적용을 일시적으로 정지할 수 있다. 4. 그러한 모든 일시정지는 외교경로를 통해 다른 쪽 서명국에게 서면으로 즉시 통보되며, 그러한 서면 통보를 접수한 날 후 30일째 되는 날 효력을 갖는다. 5. 이 양해각서의 정지 혹은 일시정지에도 불구하고, 이러한 정지 혹은 일시정지가 실행되는 날에 이미 상대국에서의 임시체류를 위한 유효한 복수입국사증을 소지하고 있는 각 서명국 청년은 그 복수입국사증이 만료될 때까지 해당 국가 영역에 입국 또는 체류하고, 그리고 그 복수입국사증에 따라 취업할 수 있도록 허가된다. 　 제9항 변경 이 양해각서는 서명국의 상호 서면 합의에 의하여 언제든지 변경될 수 있다. 　 2014년 4월 10일 서울 에서 동등하게 정본인 한국어, 포르투갈어 및 영어로 각 2부씩 작성되었다. 해석상 차이가 있을 경우에는 영어본이 우선한다. 　 대한민국 정부를 대표하여　　　　　　　　　　　　　　　　　　　　　　　　　　　포르투갈공화국 정부를 대표하여 　 　 　 MEMORANDUM OF UNDERSTANDING BETWEEN THE GOVERNMENT OF THE REPUBLIC OF KOREA AND THE GOVERNMENT OF THE PORTUGUESE REPUBLIC CONCERNING A WORKING HOLIDAY PROGRAM 　 The Government of the Republic of Korea and the Government of the Portuguese Republic (hereinafter referred to as the "Signatories"); Desiring to promote a closer co-operative relationship between their countries; Wishing in the interest of fostering mutual understanding between the two countries, to make it easier for young nationals of the Republic of Korea and the Portuguese Republic, respectively, to gain insights into the culture and daily life of the Portuguese Republic and the Republic of Korea, respectively, while simultaneously acquiring work experience; Intending to take steps to enable young nationals of the Republic of Korea and the Portuguese Republic, to make an extended trip to the Portuguese Republic or the Republic of Korea, respectively, and to take up employments an incidental activity of their holiday in the Portuguese Republic or in the Republic of Korea, as the case may be, for the purpose of supplementing their funds for the trip or for the purpose of further work-related training; and Convinced of the value of facilitating such youth mobility, Have reached the following understanding: 　 Paragraph 1 Purpose

This Memorandum of Understanding (hereinafter referred to as "MOU") establishes a framework for the co-operation between the Signatories concerning a Working Holiday Program. 　 Paragraph 2 Requirements

Each Signatory will issue multiple-entry working holiday visas valid for one (1) year to young nationals of the State of the other Signatory who satisfy each of the following requirements:

(a) they are between the ages of 18 and 30 years, both inclusive, on the date the application is received by the diplomatic mission or consular post; (b) they are Korean nationals holding a valid Korean passport or Portuguese nationals holding a valid Portuguese passport, the remaining period of validity of which is longer than twelve (12) months; (c) they are in possession of a return ticket or sufficient financial resources to purchase such a ticket and have the financial resources necessary to support themselves at the beginning of their stay; (d) they pay the current application or participation fee and any other relevant and applicable fee(s); (e) they agree to take out insurance for health care, which includes coverage for hospitalization and repatriation and is valid for the duration of their authorized stay, prior to their entry into the territory of the host State; (f) they are not accompanied by any dependants; (g) they have not previously entered the Republic of Korea and the Portuguese Republic, as the case may be, on a working holiday visa; (h) they purchase, while in the territory of the host State and when necessary, additional occupation-specific insurance; (i) they confirm their intention to travel in the host State and work to supplement their financial resources; (j) they do not possess a criminal record; and (k) they are in good physical and mental health. 　 Paragraph 3 Entry and Stay

1. Each Signatory will facilitate the procedures for the entry into and stay in the territory of its State by the Working Holiday Program participants of the State of the other Signatory. 2. The Government of the Portuguese Republic will issue to the qualified young Korean nationals a multiple-entry visa valid for a temporary stay for an initial four (4) months, extendable up to twelve (12) months, from the date of entry. 3. The Government of the Republic of Korea will issue to the qualified young Portuguese nationals a multiple-entry visa valid for a temporary stay for an initial three (3) months, extendable up to twelve (12) months, from the date of entry. 4. The visa will indicate the period during which such nationals may enter into and stay in the territory of the host State, up to a maximum of one (1) year, and will specify the reason for the stay. 5. The Signatories will issue the visas described in subparagraphs 2, 3 and 4 to the qualified young nationals through their diplomatic mission or consular post located in the territory of the State of the other Signatory. 　 Paragraph 4 Authorization to Work

The multiple-entry visa for temporary stay stipulated in paragraph 3 of this MOU enables the Working Holiday Program participants to work as an incidental activity of their holiday in the territory of the host State. 　 Paragraph 5 General Provisions

1. Young nationals of the State of one Signatory staying in the State of the other Signatory pursuant to this MOU are subject to the applicable internal laws of the host State. 2. This MOU is not intended to create any legally binding obligations. 　 Paragraph 6 Support Organizations

The Signatories will encourage the relevant organizations in their respective States to lend their support to the application of this MOU, particularly by giving advice to young nationals of the State of the other Signatory so that they can obtain information and look for work placements or employment. 　 Paragraph 7 Quotas and Applications

1. Each Signatory may issue up to a maximum of two hundred (200) WHP visas each year. 2. The Signatories may change the number of visas issued annually by mutual written consent. 3. The Signatories will determine the minimum amount of financial resources required under Paragraph 2(c), by mutual written consent through diplomatic channels. 4. Each Signatory will keep track of the number of young nationals of the State of the other Signatory who are accepted into the Working Holiday Program under this MOU and will inform the other Signatory of that number on an annual basis. 5. The tracking referred to in subparagraph 4 will begin on the date of the entry into effect of this MOU and continue to the end of the current year, and then annually from January 1 to December 31 of each subsequent year. 6. The Signatories will decide on subsequent administrative measures by mutual written consent. 　 Paragraph 8 Entry into, temporary cessation and cessation of effect

1. This MOU will come into effect on the date of its signature. 2. This MOU will cease to have effect six (6) months after the date on which either Signatory gives written notice to the other Signatory of its intention to cease it. 3. Either Signatory may at any time temporarily cease the application of this MOU, in whole or in part, for reasons of public order, public health, or national security. 4. Any such temporary cessation will be immediately notified in writing, through diplomatic channels, to the other Signatory and will take effect thirty (30) days after the receipt of such notification. 5. Notwithstanding the cessation or temporary cessation of this MOU, young nationals of the State of each Signatory who, at the date of such cessation or temporary cessation, already hold a valid multiple-entry visa for temporary stay in the State of the other Signatory, will be permitted to enter or remain in the territory of that State and to work in accordance with the conditions of the multiple-entry visa until it expires.

Paragraph 9 Changes 　 This MOU may be changed at any time by mutual written consent of the Signatories. 　 Signed at Seoul on the 10th day of April 2014, in two originals, in the Korean, Portuguese and English languages, all texts being equally valid.
