대한민국 정부와 네덜란드 왕국 정부(이하 "서명국"이라 한다)는 더욱 긴밀한 협력관계를 증진하고자 취업관광 프로그램에 대해 다음과 같이 합의하였다.
제1항 일반 1.1) 동 양해각서는 국제법 혹은 국내법 하에서 어떠한 권리나 의무도 창출하지 않으며, 서명국들의 이해와 의사를 나타낸다. 1.2) 이 양해각서는 양국 청년들에게 상대국에서 장기간 여행을 할 수 있도록 허용함으로써 양국간 문화적 교류와 긴밀한 협력관계를 증진시키고자 하는 취업관광 프로그램의 요건을 규정하는 것을 목적으로 하며, 그들 여행의 부수적인 활동으로서의 단기적 취업 및 학업이 그들 여행에 추가될 수 있다. 제2항 사증/체류허가증 발급 2.1) 각 서명국들은 자국의 절차에 따라 아래의 요건을 충족한 상대국 취업관광 프로그램 참가자에게 복수입국사증 혹은 체류허가증을 발급한다. (가) 특정 기간 동안 네덜란드 혹은 대한민국에서 여행을 주목적으로 체류하려는 자 (나) 대한민국 입국을 위한 취업관광사증 또는 네덜란드 입국을 위한 체류허가 신청시 연령이 18세 이상 30세 이하인 자 (다) 부양가족을 동반하지 아니한 자 (라) 유효한 여권과 귀국항공권 또는 그러한 항공권을 구입하기에 충분한 자금을 소지한 자 (마) 관계 당국의 판단 하에 대한민국 혹은 네덜란드에서의 초기 체류기간 동안 생계유지에 충분한 자금을 소지한 자 (바) 건강상태가 양호하며, 대한민국 혹은 네덜란드에 체류하는 기간 동안 유효하고 양국의 법률과 규정에 합치하는 의료 보험 및 종합 입원비 보험, 그리고 책임보험을 소지하기로 동의한 자 (사) 범죄기록이 없는 자, 그리고 (아) 규정된 취업관광사증 혹은 체류허가증 신청비용을 지불한 자 Note: 양국의 모든 참가자는 상대국에 도착했을 시에 반드시 결핵에 감염되지 않은 상태여야 한다. 2.2) 가) 대한민국 국민은 주한네덜란드대사관에서 워킹홀리데이 체류 허가를 신청한다. 체류허가증을 얻기 위해서, 대한민국 국민은 주한네덜란드대사관에서 ‘입국 및 체류절차’를 신청할 수 있다(결정기간은 최대 3개월). 신청자는 신청서의 처리를 위해 명시된 비용을 지불해야 한다. 입국 및 체류절차가 완료되고 신청서가 승인되면, 네덜란드에 임시 체류할 수 있는 허가증이 발급되며 참가자는 네덜란드를 여행할 수 있다. 참가자는 네덜란드에서 체류허가증을 수령하기 위해 네덜란드의 출입국이민청(IND)에 신고해야 한다. 나) 네덜란드 국민은 주네덜란드한국대사관에서 취업관광사증을 신청해야 한다. 2.3) 각 서명국은 매년 최대 100개의 취업관광사증 혹은 체류허가증을 발급할 수 있다. 신청자의 편의를 위해서, 각 서명국은 상대국 영역에 주재한 대사관 공식 웹사이트를 통해 발급한 사증 혹은 체류허가증의 수를 공개해야 한다. 2.4) 각 서명국의 대표는 필요시 취업관광사증 혹은 체류허가증 승인의 적격성을 심사하기 위해 신청자를 인터뷰할 수 있다. 2.5) 각 서명국은 (가) 자국의 법률과 규정에 따라 바람직하지 아니하다고 판단되는 참가자의 취업관광 사증 혹은 체류허가증 발급을 거부할 수 있으며; (나) 자국의 법률과 규정에 따라 바람직하지 아니하다고 판단되는 참가자가 자국 영역에 입국하는 것을 거부할 수 있다; 그리고 (다) 취업관광 프로그램 하에서 입국허가를 얻은 참가자이나, 자국의 법률과 규정에 따라 바람직하지 아니하다고 판단되는 자를 자국 영역에서 출국시킬 수 있다. 2.6) 각 국 정부는 참가자들에게 네덜란드 혹은 대한민국에 최대 12개월 동안 체류할 수 있는 허가를 부여한다. 이 기간 동안 참가자들은 각 국에서 출국하거나 각 국으로 재입국하는 것이 허용되며, 그들 여행의 부수적 활동으로서의 취업 및 학업활동에 참여하는 것이 허용된다. 2.7) 참가자들은 네덜란드와 대한민국의 법률과 규정을 준수해야 하며, 취업관광 프로그램의 목적에 위배되는 직종에 종사할 수 없다. 구체적으로, 참가자들이 성관련 산업에 종사하는 것은 허용되지 않는다. 2.8) 전문직 취업은 해당 직종에 종사하기 위한 주재국의 자격 승인 및 등록관련 규정에 따른다. 2.9) 각 서명국은 더 이상 해당 국가에 머무를 수 있는 허가가 없는 참가자의 출국을 준비 하는 데 있어 상대국 정부를 지원한다. 2.10) 참가자가 : (가) 취업관광 프로그램 제도 하에서 한 서명국에 입국하고 ; (나) 해당 서명국에 의해 출국 혹은 강제 추방되어야 하는 경우; 그리고 (다) 해당 서명국에게 여행 관련 서류를 제시하지 못하거나 하지 않는 경우, 해당 서명국은 다른 한 쪽 서명국에게 해당인의 여행 문서를 제공할 것을 요구할 수 있다. 다른 한 쪽 서명국은 해당인이 자국 국민임을 확인하고, 이러한 요청이 있은 후 7일 내에 여행문서를 제공할 수 있도록 해야 한다. 제3항 정지 어떤 서명국도 상호주의를 기반으로 공공안전, 공공질서 및 공중보건을 포함한 공공정책을 이유로 상기 조항의 전부 또는 일부의 이행을 일시적으로 정지할 수 있다. 이러한 정지와 이의 해제는 외교경로를 통해 즉시 상대 서명국에 통보된다. 제4항 개정 양 서명국은 양해각서의 개정에 대해서 언제든지 논의할 수 있다. 이러한 개정은 서면으로 이루어지며, 서명일에 발효된다. 제5항 분쟁 해결 이 양해각서의 해석 및 이행, 혹은 가능한 정지에 관해 발생할 수 있는 어떠한 문제도 대한민국 외교부와 네덜란드왕국 외교부 간의 외교경로를 통한 협의로 해결한다. 제6항 발효, 기간 및 종료 6.1) 이 양해각서는 2014년 6월 1일에 발효되어 2년 간 시범적으로 시행된다. 이 취업관광 프로그램은 시행 14개월 후 시범시행 종료 시에 평가된다. 평가 결과에 따라 취업관광 프로그램의 계속 시행 여부에 대한 공동 결정이 내려진다. 이러한 결정은 취업관광 프로그램의 시범 시행 종료이전에 내려질 수 있다. 6.2) 어느 한 쪽 서명국은 다른 쪽 서명국에 3개월 전 서면통보를 하여 이 양해각서를 종료시킬 수 있다. 6.3) 서명국이 상호적으로 달리 합의하지 않는 한, 이 양해각서의 종료 또는 중지, 또는 일부 조항의 중지에도 불구하고, 그러한 종료 혹은 중지일에 이미 유효한 취업관광사증 혹은 체류허가증을 소지하고 있는 모든 참가자는 해당 국가에 남아 동 허가의 만료일까지 취업관광 프로그램의 목적에 맞는 취업 혹은 학업활동을 지속할 수 있다.
2014년 3월 24일 네덜란드 헤이그에서 영어본에 서명하였다. 대한민국 정부를 위하여 네덜란드왕국 정부를 위하여 MEMORANDUM OF UNDERSTANDING BETWEEN THE GOVERNMENT OF THE REPUBLIC OF KOREA AND THE GOVERNMENT OF THE KINGDOM OF THE NETHERLANDS RELATING TO A WORKING HOLIDAY PROGRAM The Government of the Republic of Korea (the ROK) and The Government of the Kingdom of the Netherlands (the Netherlands) (hereinafter referred to as the "Signatories") have, in a spirit of promoting closer cooperation, reached the following arrangement on a working holiday program: 1. GENERAL
1.1) This Memorandum of Understanding (MoU) does not create any rights or obligations under international or domestic law, and expresses the understandings and intentions of the Signatories. 1.2) The objective of this MoU is to set out the provisions for a working holiday program (WHP) which encourages cultural exchange and closer ties between the two countries by allowing their young citizens to have an extended holiday in the other country supplemented by short term employment or study, as an incidental activity of their holidays. 2. ISSUE OF VISAS / RESIDENCE PERMITS
2.1) Each Signatory will issue, according to its own procedures, multiple-entry visas or residence permits for the WHP to citizens of the other country who: (i) intend primarily to holiday in the ROK or the Netherlands, as the case may be, for a specified period; (ii) are between the age of eighteen (18) and thirty (30) years, inclusive, at the time of application for the WHP visa for the ROK or the residence permit for the Netherlands; (iii) are not accompanied by dependants; (iv) possess a valid passport and a return travel ticket or sufficient funds to purchase such a ticket; (v) possess reasonable funds for their maintenance during the initial period of stay in the ROK or the Netherlands, the assessment of which is at the discretion of the relevant authorities; (vi) are in good health, and agree to hold medical and comprehensive hospitalization and liability insurance in line with the laws and regulations of both countries to remain in force throughout their stay in the ROK or the Netherlands; (vii) have no criminal record; and (viii) pay the prescribed WHP visa/ residence permit application fees. Note: Any participant of either country must be free from tuberculosis on arrival in the other country. 2.2) a) Korean citizens will apply for the working holiday residence permit at the Embassy of the Netherlands in the ROK. To obtain a residence permit, a citizen of the ROK may lodge a 'procedure for entry and residence' at the Embassy of the Netherlands in Seoul (decision period up to 3 months). The applicant has to pay the prescribed fee for the processing of the application. If the procedure for entry and residence is completed and application is granted, an authorization for temporary stay in the Netherlands will be issued and the participant may travel to the Netherlands. In the Netherlands the participant will have to report at the Immigration and Naturalization Service (IND) to collect the residence permit. b) Dutch citizens are required to apply for WHP visas at the Embassy of the ROK in the Netherlands. 2.3) Each Signatory may issue up to a maximum of one hundred (100) WHP visas or residence permits each year. For the convenience of the applicants, each Signatory will make the number of issued WHP visas or residence permits publicly available via the official website of its Embassy located in the territory of the other country. 2.4) Applicants may be interviewed when necessary by representatives of each Signatory to determine their eligibility for the grant of a WHP visa or a residence permit. 2.5) Each Signatory may: (i) refuse to issue a WHP visa or residence permit to any applicant whom it may consider undesirable, consistent with its national laws and regulations; (ii) refuse the entry into its territory of any applicant whom it may consider undesirable, consistent with its national laws and regulations; and (iii) remove from its territory any participant who has obtained entry under the WHP but whom it may consider undesirable, consistent with its national laws and regulations. 2.6) Each Signatory will grant the participants permission to reside in the ROK or in the Netherlands for a period of up to a maximum of twelve (12) months. During this period participants are allowed to leave and re-enter the respective countries and to engage in employment and/or study as an incidental activity of their holidays. 2.7) Participants will be required to comply with the respective laws and regulations of the ROK or the Netherlands and not to engage in employment that is contrary to the purpose of the WHP. Specifically, participants are not allowed to engage in activities in sex-related industries. 2.8) Employment in a profession is dependent upon the recognition of qualifications and any rules of registration of the host country for practice in that profession. 2.9) Each Signatory will assist the other Signatory in organizing the departure of participants who no longer have permission to remain in that country. 2.10) Where a participant: (i) has entered a Signatory’s country under the WHP and; (ii) is to be removed or deported from that country by the Signatory; and (iii) cannot or will not provide travel documents to the Signatory, that Signatory may request the other Signatory to provide travel documents for that person. The other Signatory will seek to provide those travel documents within seven (7) days of this request, verifying that the person concerned is a national of its country. 3. SUSPENSION
Either Signatory may suspend on the basis of reciprocity the foregoing provisions, in whole or in part, temporarily, for reasons of public policy including public security, order and health. Any such suspension, and the lifting thereof, will be notified immediately to the other Signatory through diplomatic channels. 4. AMENDMENT
Amendments to this MoU may be negotiated between the two Signatories at any time. These amendments will be concluded in written form, which will come into effect on the date of signature. 5. RESOLUTION OF DIFFERENCES
Any question that might arise with regard to the interpretation, application or possible suspension of this MoU will be resolved by the Ministries of Foreign Affairs of the ROK and the Netherlands by means of consultations through diplomatic channels. 6. ENTRY INTO EFFECT, DURATION AND TERMINATION
6.1) This MoU will come into effect on 1 June 2014 and will continue as a pilot for a period of two (2) years. The WHP will be evaluated after a period of 14 months and at the end of the pilot. Depending on the outcome of the evaluation, a joint decision will be taken about the continuation of the WHP. This decision may be taken before the end of the pilot. 6.2) Either of the Signatories may terminate this MoU by giving three (3) months’ written notice to the other Signatory. 6.3) Notwithstanding the termination or any suspension of this MoU or suspension of any provision herein, any participant, who at the date of such termination or suspension already holds a valid WHP visa or residence permit, will be permitted to remain in the country and to work or study in accordance with the WHP until the WHP visa or residence permit expires, unless otherwise mutually decided by the Signatories.
